There are times where questions may be outside of my scope of practice, and you may be refereed to additional or other professionals.  As stated in the code of ethics, no professional-client relationships will be maintained though all parts of our process.

 

While we provide guidance, support, and expertise to the best of our knowledge and ability, we cannot guarantee similar outcomes or results. Every individual’s situation is unique, and at times, various factors beyond our control can influence the effectiveness of the advice and guidance provided. The utilization of our services involves some personal decision-making along with the application of the advice provided to meet your unique needs. Please read these Terms and Conditions ("Terms", "Terms and Conditions") carefully before using our services (the "Service") operated by Alexandra Behavior Advocacy LLC ("us", "we", or "our").

  1. Acceptance of Terms By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the Terms, you may not access the Service.

  2. Description of Service Alexandra Behavior Advocacy LLC is an online platform and consultation service designed to support students, parents, teachers, and other professionals by providing touring, parent training, collaboration, resources, and additional services outlined on this website. The Service offers a variety of resources, tools, and educational materials for this purpose.

  3. Use of Service a. Eligibility: You must be at least 18 years old to use the Service. b. Account Creation: To access certain features of the Service, you may be required to create an account. You are responsible for maintaining the confidentiality of your account information and are liable for all activities that occur under your account. c. Prohibited Activities: You agree not to engage in any illegal, unauthorized, or disruptive activities while using the Service. This includes but is not limited to hacking, transmitting malware, interfering with other users' access or experience, or violating any applicable laws. d. User Content: By submitting any content (such as comments, feedback, or suggestions) through the Service, you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, adapt, publish, translate, distribute, and display such content.

  4. Services Provided a. The Company will provide services as agreed upon between you and us. b. The Company reserves the right to modify, suspend, or terminate any service without notice or liability. c. The Company will make reasonable efforts to ensure that services are provided accurately and efficiently.

  5. Payment and Refunds 5.1 All payments for direct services are non-refundable, except as outlined in clause 5.3. 5.2 Sessions are set to start at the time allotted and agreed upon by you. If you are late to a session, the missed time will not be added to the end time or made up in a future session. 5.3 If you need to reschedule a session, please do so at least 24 hours in advance using the link provided via email. Failure to do so may result in lost payment. 5.4 The Company understands that last-minute cancellations can occur due to unforeseen circumstances. Therefore, you are allowed up to 2 last-minute cancellations, where the payment can be applied towards a future session. 5.5 To apply a payment towards a future session after a last-minute cancellation, please email us at thespectrumanalyst@gmail.com. 5.6 After 2 last-minute cancellations, payments will no longer be refunded or applied to a future session. 5.7 No-show appointments are non-refundable, as we provide email and text reminders in advance.

  6. Intellectual Property Rights a. Ownership: All intellectual property rights related to the Service (including but not limited to trademarks, copyrights, trade secrets) remain our exclusive property. You agree not to reproduce, distribute, or modify any intellectual property owned by the Company without prior written consent. b. Limited License: We grant you a limited license to access and use the Service solely for its intended purposes. This license does not permit you to modify or download any portion of the Service unless explicitly authorized by us.

  7. Privacy Policy We respect your privacy and are committed to protecting your personal information. Our Privacy Policy outlines how we collect, use, and disclose your information when you use the Service. By using the Service, you consent to our collection and use of your information as described in the Privacy Policy.

  8. Confidentiality a. The Company acknowledges that during the provision of services, you may disclose confidential information. b. The Company agrees to treat all confidential information received from you as strictly confidential and will not disclose it to any third party without your prior written consent.

  9. Limitation of Liability a. No Warranty: The Service is provided on an "as is" basis, without any warranties or guarantees of any kind, either expressed or implied. b. Indemnification: You agree to indemnify and hold us harmless from any claims, damages, liabilities, costs, or expenses arising out of your use or misuse of the Service. The Company shall not be liable for any direct, indirect, incidental, or consequential damages arising out of or in connection with the use or inability to use our services. 

  10. Termination: We may terminate or suspend your access to the Service at any time without prior notice or liability for any reason whatsoever, including but not limited to a breach of these Terms.

  11. Governing Law: These Terms shall be governed by and construed in accordance with the laws of the state. Any disputes arising under these Terms shall be submitted to the exclusive jurisdiction of the courts.

  12. Changes to Terms and Conditions: We reserve the right to modify or replace these Terms at any time without prior notice. It is your responsibility to review these Terms periodically for changes. By continuing to access or use the Service after revisions become effective, you agree to be bound by the revised Terms.

  13. Severability If any provision of these terms and conditions is found to be invalid or unenforceable, such provision shall be severed from the agreement, and the remainder of the agreement shall continue in full force and effect.

  14. Entire Agreement These terms and conditions constitute the entire agreement between you and the Company, superseding any prior agreements or understandings, whether oral or written.
